Downham Ladies Fitness is owned and operated by Lisa Jarratt. We take your privacy seriously and as such have laid out the following privacy notice in line with the General Data Protection Regulation 2018.

By using our facility and any of our services you agree to be bound by the policies set out in this privacy notice. We are fully committed to protecting the privacy and safeguarding the use of your personal information and we will look to keep this privacy notice updated, therefore check back here regularly to review any amendments.

What data we collect and how we use it

We collect and process your personal information (such as name, date of birth, contact information, bank account and payment information and information relating to health conditions and usage) in order to administer your accounts and subscriptions with us – to process orders, payments or applications submitted by you.

We also use it to carry out our obligations in relation to any agreement or contract you have with us including any subscription to our service, or to verify your identity.

We will not share your data with any third party other than those utilised to service our business or if legally obligated to do so. External partners (processors) may be utilised to perform tasks including but not limited to: processing payments, making bookings, marketing, accounting and account management – we agree terms with all our partners to ensure that they all comply with high levels of confidentiality and best practice in privacy and security standards in line with the General Data Protection Regulation 2018.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place a number of electronic and administrative procedures to safeguard and secure the information we collect and store.

Information about products and services and marketing

From time to time we may send you details of products and services that may be of interest to you via email. This is only if you opt to receive this information, via informed opt-in consent.

Your rights and keeping our records up to date and accurate

You can opt out from any promotional, non-essential or marketing content at any time by clicking the unsubscribe link in an email or by contacting us directly.

You may also contact us directly to request information about what data of yours is recorded by us, how it is stored and what it is. If you would like a copy of the information held on you please write to us. You also have the right to lodge a complaint with a supervisory authority if you feel your privacy has been violated.

In general we retain and process personal data for a reasonable period following initial enquiry, purchase or the lapsing of an account with us. Certain records such as health screening forms may be retained for a longer period, in line with fulfilling contractual obligations of due care to our customers and visitors, in line with industry standards.

Third party sites, apps and services

We cannot be responsible for the privacy policies and practices of other websites, apps or services even if you access them using links from our sites, or during the delivery of our services. We recommend that you check the policy of each site you visit, any apps you use or any third party services that you may register with.

Social Media

We advise Members and visitors to ensure that if they are to take photos or record video on the premises, that no other individual appears in the footage . We do occasionally arrange filming or photographs for use on our Social Media or other communications. All due care will be taken to ensure that no one appears in filming or content created by us without expressing consent to be included. If you find you do appear in error, and would like an image or video of you to be removed from our Social Media channels or communication please contact us immediately.

Disclosing your information to others

Other than the disclosures referred to in this policy, we will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

DOWNHAM LADIES FITNESS TERMS & CONDITIONS

1.Terms & Conditions

1.1 Downham Ladies Fitness is owned and operated by Lisa Jarratt.

1.2 These terms and conditions include the services provided by Downham Ladies Fitness.

2.Membership Options/Bookings

2.1 Membership options are set out within the GoTeamUp app. Once a member, bookings for classes can be made through the GoTeamUp booking system.

2.2 All Memberships are paid for by monthly subscription. Payments are made via Direct Debit (Go Cardless) and once established payments will be taken on the 1st of the month or on a day of the month nominated by the member.

2.2 Classes are subject to availability though we will do our best to accommodate you. Trainers may change from those scheduled to lead a class and Downham Ladies Fitness cannot guarantee any trainer will be available for any class. All membership options must be prepaid and classes prebooked and are subject to our cancellation policy below.

2.3 It is a condition of acceptance of membership that the member agrees to be bound by these terms and conditions.

2.4 Downham Ladies Fitness reserves the right to reject any application for membership without giving any prior notice or to cancel any membership without notice subject to 4.3 of these terms and conditions.

2.5 Membership is personal to the member and cannot be transferred.

3. Pricing

3.1 Information is displayed on our Ladies Group Fitness Classes Page. Pricing is subject to change by Downham Ladies Fitness. Information and pricing on Personal Training sessions available on request.

4. Code of Conduct

4.1 Members are expected to behave in an orderly fashion at all times whilst training with Downham Ladies Fitness and shall be responsible for any injury they may cause to others and for any damage done to any property.

4.2 No alcohol may be brought by members into Downham Ladies Fitness venues and smoking is strictly forbidden anywhere in Downham Ladies Fitness venues. In addition, members may not enter the Downham Ladies Fitness venues under the influence of alcohol or bring into Downham Ladies Fitness venues any non-prescription drugs or illegal substances.

4.3 Failure by any member to comply with these terms and conditions including this code of conduct will entitle Downham Ladies Fitness to terminate a member’s membership without any refund.

5. Lateness Policy

5.1 If the client is late to a class it cannot be extended and will end at the appointed time.

5.2 If the Trainer is late additional time will be added to the class or to subsequent class.

6. Cancellation/Refund Policy

6.1 Payment for all classes must be made in accordance with the relevant Membership Option prior to any sessions booked.

6.2 Cancellations for any classes must be made 12 hours before the class starts; any cancellation within 12 hours of any class will not be refunded.

6.3 Memberships may be suspended for up to 2 occasions during the 12 months. The duration of the suspension can be between 2 and 12 weeks. Additional weeks will be charged at £10 per week in advance. Billing will be suspended during the suspended membership and resumed at the end of the period.

6.4 Memberships may also be suspended due to medical reasons by providing a note from a doctor.

6.5 Memberships may be cancelled at any time after the payment of the first month’s fees. Notice must be given at least 5 working days prior to the next payment to ensure no further payments will be taken.

7. Suspension of service

7.1 Downham Ladies Fitness will use their reasonable endeavors to ensure Downham Ladies Fitness is open as set out on our Facebook Home Page. There may be occasions, however, when Downham Ladies Fitness may be closed or a trainer may not be available for reasons beyond our control as, for example, for essential maintenance purposes or illness of the trainer.

7.2 Downham Ladies Fitness may suspend the operation from time to time.

7.3 Downham Ladies Fitness reserves the right to reduce the number of classes over Bank Holidays, Annual Leave Periods and the Christmas/New Year period.

8. Due care

8.1 Any training provided by Downham Ladies Fitness will be carried out with all due care and attention.

9. Disclaimer of Liability

9.1 All members use Downham Ladies Fitness venues at their own risk. Neither Downham Ladies Fitness nor its agents or employees shall be liable for:

9.1.1 the death or personal injury of any member whilst in or using Downham Ladies Fitness services except to the extent that death or personal injury arises from any negligent act or omission of Downham Ladies Fitness or any agent or employee thereof; or

9.1.2 any loss, damage to or theft of personal property belonging to the member occurring in Downham Ladies Fitness venues.

9.2 It is all member’s responsibility to determine that they are fit and well before attending any sessions or group exercise classes and members are advised to undergo a medical examination prior to beginning any physical activity program. In addition, all Members must complete a Physical Activity Readiness Questionnaire (PAR-Q Form) either online through GoTeampUp app or handwritten.

10. General

10.1 Downham Ladies Fitness may change these terms and conditions from time to time and by reading these terms and conditions you are accepting that you are bound by the current terms and conditions which form the entire understanding of the parties and supersede any previous agreements, understanding and representations.

10.2 These terms and conditions shall be governed by and interpreted in accordance with English law.
